INFORMATION FOR CLIENTS

Main characteristics of our Product that we distribute through Internet are in accordance with regulations of Commercial Law, article L 111-1 (www.lumieresdebaia.com)
The prices are given for every product and in every link. Apart from total cost of order (i.e. amount of element prices from order list) and final cost (amount of prices from order list plus cost of delivery) all other expenses connected with website access are under customer.

TERMS AND CONDITIONS

Terms of our offer for Product and prices depend of its actualization on our website. Our offers are valid until them accessible on website. 

Deliberation

According to Commercial Law, after receiving the Product Customer has seven days to test it. During this term Customer can return the Product for changing without any punitive measures on address shown under.  But all expenses for delivering should be paid by Customer. In case of changing the new Product will be delivered to Customer within seven days after returning.

2 – Follow website instructions.
3 – Follow instruction for opening of User account 
4 – Fill the form of order.
5 – Check for errors and correct 
6 – Confirm the order and price.
7 – Confirming of electronic order on lumieresdebaia.com.
8 – Confirming of order: shipping dates and delays.  
9 – Receiving of order.
10 – Withdrawing from Customer account total cost for delivered Product and transport charges. 

Customer should strictly follow requirements of this agreement concerning of opening an account, filling the forms, ordering the Product,   transferring personal data, credit card number and other confidential information.

PRICES AND INVOICES

Our prices include taxes. 
According to Commercial Law, every customer receive an invoice.  

TERMS OF PAYMENT

All payments should be done through Paypal or major credit cards (Visa, Mastercard, intract...) and  bank transfers.

All details of Customer bank account should be transferring trough Paypal secure host and Moneris Solutions. It is strictly prohibited to show this information on Lumières de baia.
Only information about orders should be liable to automated data processing. 

DELIVERY

Customer can follow up status of order from his personal secure profile on lumieresdebaia.com.
When ordering the Product Customer should indicate the address of delivery. 
Customer is not available on delivering address he will receive delivering note in his mail box. Within 10 days after receiving delivering note Customer should collect his package from the nearest post office.  In case of express delivering Customer also will receive the delivering note. After receiving such note he should contact the carrier and specified the delivery date. Customer has a right to indicate in order of the Product any address in the world.

All information concerning delivering will be sent through e-mail.

Lumières de baia delivers the Product to any part of North America, Europe and other part of the world. Terms of delivering are always approximate.  In case of excess of delivery terms it will not be the constitute justification for reimbursement. But if within 30 days after preliminary delivering the Product will not be delivered (except cases of force majeure) every part of this agreement has a right to break off the agreement and Customer will receive all the money he paid for Product without any other repayments. Circumstances that classified as farce-majeure and when Lumières de baia has a right of termination for the delivery: armed conflicts, mass riots, fires, flooding, strikes, accidents, impossibilities of delivery…..

In any case delivery of our Product in time mostly depends on implementation of Customers responsibilities in accordance with this agreement. In any time the delivering Product could be followed up in carrier system such as UPS website for express delivering.

When receiving Customer should check the Product and file all the claims or refuse the Product if the package was open before or Product has clear signs of damages.  All claims should be sent to carrier with registered letter within three working days after Product delivering. One copy of claim should be sent to Lumières de baia. According to Commercial Law, neglect of this responsibility during specified period cancel any actions with respect to carrier and at such circumstances Lumières de baia cannot be represent as guarantee.

In case of delaying, and delivering the Product damaged or flawed Customer may contact our Support Service. In case of electronic selling no claims can be done if the Product was checked in the shop.  

Product can be delivered by:

• UPS – Recommended for express delivering all over the world.
• Canada Post for delivering inside Canada.

Customer receives electronic massage about sending of Product and following number for Product. This following number could be used on following websites: http://www.ups.com/WebTracking/track, http://www.trackingnumber.org/canada-post-tracking. In case of any complaint Customer should indicate his following number in letter for Lumières de baia.com.

CUSTOMS AND DUTY FEES  

If you are based in Canada, you won't have to pay any additional fees (customs fees, duties).
If you are not based in Canada, please note that all shipments may be subject to import duties and taxes, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. For more information we suggest you consult with customs in your country.

COMPLAINTS AND RETURN OF PRODUCT

No return of goods can be accepted without our preliminary agreement. The goods must be forwarded in its original packing, in perfect condition and accompanied with the motive for return. The return has to be made in prepaid for a maximum of 8 days following the date of reception.

All expenses and risks concerning return of Product are responsibilities of Customer. 

Product that was returned damaged, dirty or not full will be not reimbursed by Company.

The Privacy Policy and Security Statement form part of the Terms and Conditions.

COPYRIGHT

The Site, its design, and all content included on the Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of Lumières de Baia or its content suppliers, and is protected by Canadian and international copyright laws. The Works may contain, from time to time, material that is the copyright of a third party.

TRADEMARKS

The mark, indicated on the Site, is a registered trade mark of Lumières de Baia in Canada and other countries. The mark may not be used, in any way, without the prior written permission of Lumières de Baia.

LICENSE

Lumières de Baia grants You a limited, non-exclusive, revocable license to: access, use, and download the Works contained in the Site solely for non commercial and personal purposes; access and use the Site solely for non-commercial and personal purposes; and if You are an internet service provider, supply the Works contained in the Site to Your subscriber.

Any conduct with respect to any of the Works contained in the Site including, without limitation, the reproduction, modification, adaptation, transmission or communication of such Works without the prior written permission of Lumières de Baia is strictly prohibited.

INDEMNITY

You agree to indemnify Lumières de Baia and hold Lumières de Baia indemnified from and against any and all actions, liabilities, claims, costs and expenses (including reasonable legal costs and expenses) arising out of Your use of the Site or any breach of the Terms and Conditions by You, including, without limitation, Your warranties and representations with respect to the Material.

APPLICABLE LAW

The Terms and Conditions shall be governed by, and construed according to, the laws of the Province of Ontario, Canada. Any dispute under the Terms and Conditions shall be subject to the non-exclusive jurisdiction of a court of competent jurisdiction in Ottawa, Canada and, by using the Site, You hereby submit to that jurisdiction.
